 LUBA Prohibits RV Park Adjacent to Bandon Marsh

In a stunning opinion, LUBA reversed Coos County's approval of the Coquille RV proposal that Oregon Shores and local residents have been fighting for more than two years. This was the second round of appeals. Back in 2008 Coos County approved the 179-slot RV park proposed by Hank Westbrook on the Coquille River two miles north of Bandon. Oregon Shores and local residents appealed to LUBA, which remanded the case back to Coos County for more work and better consideration of some legal requirements. But the only real change in the new proposal was slightly reducing the number of RV spaces to approximately 150 slots. Coos County approved the "revised" application, and Oregon Shores appealed to LUBA again.
In this new opinion, LUBA reversed the County's decision as a matter of law, holding that it did not meet the requirements of Goal 11 (Public Facilities and Services) and Goal 14 (Urbanization). This is principally because Westbrook was proposing, not a traditional RV park, but a permanent urban cluster of "park model" RVs, which would stay in place, though the tenants might change. LUBA noted that this is rather like a hotel, and is contrary to the land use laws, which require urban densities to be confined to urban areas.
