 Application Withdrawn for Residential Development at Arcadia
James Smejkal proposed to build a rural housing development on his 17-acre property across Highway 101 from the remainder of Arcadia State Park — of which his land was originally a part, until he received it in a trade with the Parks and Recreation Department in 2002. In a letter addressed to the Clatsop County Planning Commission on May 3, Mark Barnes, Smejkal's planning consultant, said that Smejkal had decided to withdraw his application due to threats of litigation and appeals from the Department of Land Conservation and Development, as well as many angry neighbors and conservation groups, including Oregon Shores.
The application was controversial from the outset, because in order to develop eight houses on the land Smejkal had to win a zone change from the two present zones, Agriculture Forestry and Recreation Management, to Residential Agricultural. The area is partly surrounded by commercial timberland and is also steep and poorly suited to development. He would also have had to apply for exceptions to several land use goals, which is a complex and lengthy process.
Both Oregon Shores and local residents will be watching carefully to see what future proposals Smejkal might consider for his property.
